Negro for sale in So. Carolina, old statute

Negro for Sale. Jacob Walker, a negro who has been convicted of larceny in Kent County, Maryland, is to be sold for the term of two years to the highest bidder for cash, in the Jail Yard in Charlestown today, Dec. 9, 1865. This is to be done under an old statute, it being argued that the amendment abolishing slavery in the State Constitution expressly permits slavery or involuntary servitude for crime whereof the party shall be duly convicted, and that Congress, in enforcing the amendment to the National Constitution, which is in the same words, has no power to annul such State laws as may punish crime by the enslavement of the criminal.
